3 years after 2 homes buyers get refund with help of MahaRERA

On Monday, Nirmal Lifestyle Kalyan Pvt Ltd a real estate firm was forced to refund booking amount for two flats by Maharashtra Real Estate Regulatory Authority (MahaRERA). After a complaint launched by Thane resident Mansi Shrivastava and Sandeep Ranjan.

In 2013, they both had booked their flats under MahaRERA-registered project by paying Rs 6.10 lakh and Rs 6.26 lakh for the flat of Rs 30 lakh. They both received Rs 1 lakh  from Nirmal Lifestyle after cancelation booking in 2014 and rest of the payment was pending.

According to MahaRERA member Vijay Satbir Singh, “MahaRERA has given stakeholders a platform to come together to resolve disputes through negotiation.”

“They never said they would not return the amount, but they never paid it till the matter was brought before MahaRERA”, said the Ranjan

A RERA official said that the buyers were assaulted, due to the construction firm’s attitude. “RERA has come has a boon to them”, he said. After the RERA got in action, the firm simply issued two cheques of Rs 5.10 lakh and Rs 5.26 lakh to the applicants.

  1. In the write-up, claim for refund and interest are said to be in respect of a project registered in 2013 under the RERA. If one is not mistaken, the MAHA RERA and the Rules, as made final, came to be implemented only much later; and the last postpone due date for registration was May 1, 2017. If so, one is confused about the dates mentioned ?!
