The court sentenced builder for two years imprisonment last week for cheating the government by not giving 12 flats as was agreed under the Urban Land Ceiling and Regulation Act (ULCRA).
Under ULCRA the government gave permission to carry out construction in Dahisar land. But, the builder (Harishankar Kayal) only gave 3 flats to government and rest sold to others.
“I have come to the conclusion that the property was handed over to the accused who sold it in the open market and obtained consideration with fraudulent intention. Therefore, the prosecution has proved beyond reasonable doubt the offence against the accused”, the magistrate court held.
Tulsibai Keni, owner of Dahisar land, under the ULCA, applied to the government for construction of building on the land in the 1980s. The government permitted to construct a building on land and instructed Keni to hand over 20 tenements on the land on July 30, 1987.
The government in 1989 directed Keni instead of handing over 20 tenements provide 12. There was a mistake in the order and corrected.
Sanjanwala was handed over the construction work, and which it selected Somesh Developers for it. The legal complaint alleged that the accused constructed building and handed only 3 flats to the government.
After 31 years of cheating the government, builder sent behind the bars.
