A builder or developer is liable to pay taxes such as property taxes until they transfer the entire property to co-operative housing society said the Mumbai suburban district consumer forum yesterday. A division of bench MY Mankar and SR Sanap said, said as per the Maharashtra Ownership Flats Act 1963 which states that the builder or developer must clear municipal taxes, property tax and water charges among other until they transfer the entire property to flat purchasers or the cooperative housing society.

    I am a Mumbai Citizen. I am currently living in a Building which is controlled by a Builder. He has around 750000/- Property Tax pending to pay. We have already paid pur maintanence and Tax due to him.

    Now after a long time, we are ready to form a New Society. The Old dues are still pending. We shall get a Registration Certificate soon.

    Is it possible that the Old dues will go in the name of the builder itself and we can opt for individual property tax or in the name of New Society Form with Zero Outstanding.

    Pls. let us know a way out if any for this property tax can be transferred in the name of the builder and we can start a new entity or society by opting for New Account of Property Tax.
