Conveyance Deed still a dream for flat buyers in Maharashtra

The procurement of deemed conveyance when first introduced in 2008, the decision was considered as a landmark to protect the interest of the buyers.  But if we see today scarcely only 88,000 housing societies have applied for it, making more worse the situation the land that has been conveyed to housing societies in only 700 cases.

CM, Prithiviraj Chavan on 27th November meeting has asked the officials to undertake a statewide drive from December 1 to reach across to all housing societies, the state govt. not taking action against the builders not providing conveying the land within the given time.

A conveyance deed is a document which gives a property’s title of ownership from the original owner to the ultimate purchase. Under Maharashtra Ownership of Flats (A regulation sale, management, transfer) Act, 1963, it is mandatory for a developer to convey the land to housing societies within four month’s of the society formation.

The provision for deemed conveyance was included in the same Act to allow societies o approach a district deputy registrar (DDR) in case the rule was not followed. One of the senior officials said that action under clause.

The biggest hurdle is the lack of regulation in how agreements-to-sale OR sale-deeds are made … it seems lawyers themselves endorse unlawful sales like those of common areas – common terraces, common stairways, common plots, etc … in such sale-deeds and there needs to be a solution for this more than anything. There has to be a regulatory body that ensures that unsaleable areas are not purchased by unwitting buyers who are unaware of MOFA.

    according to the builder terms and conditions the building is proposed to get completed in dec 2014 i have to pay 20% at the start then pay the society formation registration charges vat service tax3.09 % the total cost is around 1725000 for 615 sq feet single hall bedroom flat i have paid the 20% and the registration society formation money as per builder schedule which was on sep 7th 2012 the problem is uptill now the builder has not done registration on my name he keeps on giving date and the dates are later postponed this is going on for last 6 months more that 20 dates he has given i dont understand what is taking him so long to do the registration when he has already paid the stamp duty money still the registration office is delaying the registration on my name please someone guide me
