FIR filed against Gurugram developer for selling flats without license

The department of town and country planning (DTCP) logged a First Information Report (FIR) against the Gurugram based developer, 1,000 Trees Housing Private Limited for violating the rules and regulation of Haryana Development and Regulations of Urban Areas Act, 1975. The developers use to take payment and book flats in Sector 105 before getting a license from the department.

The complaint was filed by Abhishek Gupta and Neha Gupta with the help of CM window in June 2017. According to Abhishek, “We had booked a flat in 2012 and the developer had promised us the possession by 2015. But for last three years, no construction work has taken place at the site.”

After an investigation, they found that the developer had collected around Rs 14 lakh from Abhishek and Neha Gupta in 2012 for provisional Unit No F-201, 2nd Floor, Tower-F in the housing project even before getting a licence from the department, according to DTP (enforcement) Rajendra T Sharma.

The payment of Rs 14 lakh was collected as unsecured loan carrying an interest of 15% per annum and the agreement was signed on February 03, 2014, a developer told when he was asked to submit the copy of valid license along with its building plan on July 5, 2017.

According to Sharma, “License was issued in December 2012, while developer had collected the payment in July and August 2012.”

The project was to come up over 13.07 acres of land with 13 towers and 852 units.
