The Allahabad High Court on 14th December, 2016 quelled the land acquisition process drawn in favor of Ansal properties some 8 years ago in Ghaziabad.
The land, which is in Pargana Lori village of Ghaziabad, was acquired by Ghaziabad Development Authority (GDA), and later was provided to the Ansal properties for construction of residential colonies. The development agreement was signed between the company and the GDA in 2007.
The issue came to light when Devaki and several other residents of the village whose land has been acquired by the GDA filed a writ petition challenging the legality of the land acquisition that was passed on to private entity.
A Division Bench comprising Justice Arun Tandon and Justice Sangeeta Chandra passed the order allowing the petition and set aside the acquisition, observing that the land was acquired by the authority only for the benefit of a private company- a fact that is in direct contrast with the rule of law that states that land cannot be acquired in a bid to “benefit private companies” by permitting them to construct residential colonies.
