The Punjab and Haryana high court has come to rescue of Gurgaon residents as they were charge interest for the plot which they has not been allocated. The court recently ordered HUDA authorities to refund the amount which has been deposited by the petitioner towards interest. One of the victims has not got the physical possession of the plot; he paid Rs. 13, 21,320 and within 30 days from the date of issuance of the above letter and the amount was paid in six annual installments with 11% interest.
HUDA though could not provide the possession of the plot due to encroachments but still started charging interest on the balance of the payment due. After hearing the arguments the court held that it is clear from unauthorized occupation and the petitioner has been offered possession of the same. The court also observed that petitioner may take possession of the site in dispute by making an application before the HUDA; the matter should be brought to the notice of the officials.
The court held that the charging of interest on the balance payment is concerned as per the terms and condition of the allotment letter.
