Maha RERA soon to entertain complaints of unregistered projects

MUMBAI

In a move to protect homebuyers Maharashtra Real Estate Regulatory Authority (Maha RERA) will now entertain complaints related to unregistered projects. It said necessary modifications / up-gradation of the online software system will be made within a period of 15 days from today (July 31).

The two bench of Justice V.M. Deshpande and R. M. Borde, Bombay High Court on July 31, while hearing the writ petition filed by Mohammed Zain Khan (petitioner) against Maharashtra Real Estate Regulatory Authority and others eight (Respondent) it said Maha RERA can entertain complaints of unregistered projects.

Khan was making his grievance in respect of the failure of the MahaRERA Appellate Authority to take cognizance of the complaints tendered by the complainants in respect of the unregistered project.

The counsel appearing on behalf of respondent No.1 it stated that “At present, the online software system is not equipped to entertain the complaints in respect of the projects which are not registered under the RERA Act. It is further stated that the necessary modifications / up-gradation of the software will be made within a period of 15 days from today.”

Earlier, the complainant had to send an e-mail regarding the unregistered projects and later on authority use to direct the promoter to register the project. After that complainant can file a case with the regulator, a source said.

As of now, over 17,500 projects have been registered in the state and over 3,730 complaints have been filed with the regulator from which 2,192 orders have been passed and 1061 complaints are pending.

On completion of the process of up-gradation of the software equipped of receiving on-line complaints, in respect of unregistered projects by the MahaRERA within the time stipulated as above, it would be open for the Petitioner to register the complaint in observance of the procedure prescribed in that behalf, respondent said.

He said, the complaint tendered on-line by the Petitioner and other similarly situated complainants, in respect of unregistered projects would be entertained and the same would be dealt with in accordance with the procedure that is being adopted by MahaRERA in respect of disposal of complaints in relation to registered projects. “The above statement is made by the learned counsel appearing for Respondent No.1 on instructions from V.G. Wani, Administrative officer of MahaRERA who is present before the Court”, bench read.

The bench heard and stating that, “In view of the statement made as above, the grievance raised in the Petition stands redressed.”
