In a move to provide relief to a home buyer, National Consumer Disputes Redressal Commission has directed Unitech Limited to refund a principal amount of approximately Rs 40 lakh to a home buyer for not handing over the possession of an apartment even after the lapse of almost 7 years.
NCDRC has asked the realty firm to refund the amount of Rs 42,58,475 within six weeks to Noida Resident and also said to give a compensation of simple interest at 12 % per annum. The firm had delayed almost 7 years to hand over the possession.
Presiding Member of the Commission Justice Deepa Sharma said that the refund of the amount of Rs 42,58,475 should be made as early as possible to the complainant within six weeks along with a compensation of 12 per cent per annum from the date of payment till the realisation of the amount.
As litigation cost Rs 10,000 to be paid home buyer, the commission asked the firm.
The apartment was to be delivered to Kapoor by November 15, 2008, as per the allotment letter.
