  3. My father along with his brothers carried business together after my grandfathers dead.they took purchased properties and finally there took a partation and my dad got his share. i dad pays income tax under HUF status. does y dad has right to make a will for all the properties

  4. sir/Madam,Whether Leave & Licence Agreement entered between one of legal heir whose name in Society record is in capacity of Nominee, without obtaining consent from other Legal Heirs, and ignoring written objection of other legal heirs is valid.Case law reference, if given will be helpful.

My granfather left a will in which he left property for the benefit of HUF of his son.The son got the property mutated an d registered in his name.However the rental income was always declared as HUF Income.The assessing officer insisting that property being in individual name ,the income from it is not HUF Income but individual income.Please guide.

  8. SIR, iF DDA FLAT WAS PURCHASED BY UNMARRIED DAUGHTER WORKING PARTLY WITH GPF FUND AND PA[RTLY WITH WIDOW MOTHERS PENSION DOES IT AMOUNT TO PROPERTY ACQUIRED WITH AID OF JOINT FAMILY FUNDS.
    IT WAS A DDA FLAT ALLOTTED BY DRAW OF LOTS TO DELHI BASED DAUGHTER A GOVT EMPLOYEE CONVEYANCE DEED AND POSSESSION FROM 1987 TILL DATE IN SELF NAME. MOTHER DIED 1989 INTESTATE.SIBLINGS FILED PARTITION SUIT.CAN I TAKE PLEA OF GIFT OR LOAN

    Our family(HUF of Odisha) had done memorandum of partition in the year 1986 , on the basis of which each share holders selling their share portions without any litigation. But, last year odisha Govt. prohibited this type of sell & insists only a Property owner can sell his property. Accordingly after showing Family arrangement of 1986, in P&CLA we all share holders applied & received an order in favour of respective share holders portions. After getting the order of P& CLA (which is equivalent to decree of a civil court as clarified in NALSA website also) as well as memorandum of Partition of 1986; when we asked ROR from Tahasilder, he asked us to file in 19(C) OLR act format only & now one of our share holder does not want to sign the 19(C) format & in this condition we are not getting ROR. Please inform the solution.
