RERA Act: States have to conform to central law says Puri

As the West Bengal Government enacted its own Real Estate Act, Union minister for housing and development, Hardeep Singh Puri, told the press on September 18, 2018, that there is no confusion when it comes to the implementation of the centre’s RERA and states have to comply in accordance to it.

Puri also said that a letter has been written to the state government in regard to this issue. Centre has directed the Banerjee’s government to remove its newly formed legislation, as there is already a central law, a source said.

The West Bengal government has recently issued a notification in regards to its Housing and Industrial Regulation Act, 2017, instead of implementing the RERA Development Act 2016.

Some law experts suggested that the West Bengal government’s HIRA needs to get the presidential assent for its law, owing to the central law.
