Residents in agony with no OC

Unfinished construction and lack of required documents, residents of
Sukhakarta Cooperative Housing Society of sector 40, Nerul are living in misery as they
are deprived of the basic amenities because they do not have the occupancy certificates
(OC) of their building. The builder, Sadruddin Bashar Khan, who sold them the flats
around seven to eight years ago, assured them that the OC will be provided within a
couple of months of their taking possession, but they have not received it till date.

It will be difficult for any occupant to survive without the fulfillment of basic rooftop
which is a compulsion for a constructed house to have. The builder has not constructed
roof top above 6th floor on many flats in the society. Though the residents have been
approaching the builder as well as the civic authorities asking for a solution, no one has
been able to give a clear explanation for the delay. Instead, the builder threatens them of
dire consequences if they force him the get the OC, allege residents. The residents faces
severe problems whilst monsoon.

Adding to the misery, there are two lifts that are not in working condition from past few
months. It is problematic for the senior citizens to climb stairs. The builder has been
collecting maintenance charges i.e. Rs 1/ unit from the residents for last many years,
but did not bother to provide them minimum services of a sweeper, security guard and
so on. Therefore, the residents have not been paying him the maintenance charge since
November 2011.

Madhukar Naik, a resident said, “We have come to know through the RTI that the builder
has not provided nine important NOCs like fire, lift, environment, PWD and so on to
the town planning department of NMMC and that could be one of the reasons, why it is
taking inordinately long time to get the OC.” “Since there is no managing committee, we
cannot take any decision on our own. In the absence of the security guards incidents like
thefts are very common and we feel unsecured to stay in the building.” revealed Naik.
The builder, Sadruddin Bashar Khan, however, denies that he is yet to submit any NOC
to NMMC. “We have submitted all the documents to the concerned department of the
civic body and are making all efforts to get the OC.”
