The National Green Tribunal has paved way for sale and purchase of properties in the industrial sectors of Noida from 10th April. The Authority has ordered that lease transfer applications of the industrial units pending which be executed. But it has also imposed the condition that the new owners would not set up any unit that would cause environmental pollution. The Noida Authority had been completely halt on transfer of the industrial plot and properties ever since the tribunal had forced them to do so as the pollution has gone way far. A bench of justice has directed the authority to allow for paper transfer of the industrial properties only upon the undertakings that any liability caused on account of pollution will be holey and solely be the responsibilities of the owner. Any pollution caused the owners has to compensate in lieu of polluter pays principal.
The tribunal has further directed for constitution of an internal mechanism by the Central Pollution Control Board by forming a committee to examine cases of transfer in respect of polluting industries. However the industries which have been identified as absolutely non-polluting in nature by the UPPCB have been excluded from this exercise
