In an Special Writ Petition no (Diary No) 23708 of 2017 filed by Maharashtra Chamber of Housing Industry ( MCHI), Supreme Court has may give relief to thousands of societies which were stand still on redevelopment process because Mumbai Municipal Corporation stopped giving IOA and CC to new redevelopment projects for want of no solution to dispose of Debris.
Pending the hearing and disposal of the Petition, the Apex court may ask BMC/ State Government to permit or grant permission / IOD after taking an undertaking from all the respective applicants to the effect that:-
The construction and demolition waste may be now disposed off as per the Waste management Plan at the land filling sites ( eg:- Sector 25, 25A of Vahal, Ulwe Node, Navi Mumbai and CTS No. Survey No. 153 to 160 village of Moure Sasunavghar, Mumbai – Ahmedabad Highway, Taluka Vasai, District thane); and
In case of any wet solid waste, the same shall be disposed off on the construction site itself and in case of any dry solid waste, the same shall be disposed off in a manner that the same is not dumped at Deonar and/or Mulund Dumping grounds.
With this interim relief which may come up in next hearing soon, a flood gate will be open for society redevelopment which was stand still for almost two years. Huge supply is eminent by 2020. Many stand still projects which got IOD / CC also now will take off.
